Terms of service

These terms are a contract between you and Uptrail ("we", "us") covering your use of the Callie app and service. By creating an account or using Callie, you agree to them.

1. Callie is an AI

Callie and Cal are artificial-intelligence companions. They are not real people, and the app will never tell you otherwise. Callie is for companionship and entertainment — she is not a therapist, doctor, lawyer, financial adviser, or emergency service, and nothing she says is professional advice. AI-generated responses can be wrong, inconsistent, or incomplete. If you're in crisis, contact a real human via our crisis resources or your local emergency number.

2. Who can use Callie

You must be at least 18 years old (or the age of majority where you live). By using Callie you confirm that you are. You may hold one account, created through Sign in with Apple.

Don't use Callie to break the law, harass or harm anyone, or attempt to harm the service. Specifically, you agree not to:

We may suspend or terminate accounts that violate these terms, with notice where practical.

6. Your content

You own what you write and say. You grant us the limited license needed to process your messages and call audio to operate the service — generating responses, building memory, and creating Moments — as described in our privacy policy. Moments and other generated content are for your personal use.

7. Disclaimers

Callie is provided "as is" and "as available". We don't guarantee the service will be uninterrupted, error-free, or that any particular call will connect. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Nothing in these terms excludes rights you have under consumer law that cannot be excluded — including any statutory guarantees under the Australian Consumer Law.

8. Limitation of liability

To the maximum extent permitted by law, our total liability for all claims relating to the service is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect, incidental, special, or consequential damages.

9. Ending things

You can stop using Callie and delete your account at any time in the app (You tab → Delete account); deletion removes your data as described in the privacy policy. We may suspend or terminate the service or your account for breach of these terms, or discontinue the service with reasonable notice.

10. Changes to these terms

We may update these terms; the effective date above will change and material updates will be flagged in the app before they take effect. Continuing to use Callie after changes take effect means you accept them.

11. Governing law

These terms are governed by the laws of New South Wales, Australia, and disputes are subject to the non-exclusive jurisdiction of its courts — without limiting any mandatory consumer protections in your country of residence.
